Fabian Walderich

Lawyer

born in 1984; attended the University of Tübingen; Attorney-at-law since 2013. Employed at a major inter-national law firm from 2013 to 2015 and at Thümmel, Schütze & Partner since May 2015. Mr. Walderich is a specialist attorney for labour law and member of the Labour Law Group of the German Bar Association.

Mr. Walderich advises and represents primarily em-ployers, but also managing directors and senior man-agement, in all matters concerning individual and collective labour law, both in and out of court. A focus of his work consists of advising in the area of termina-tion law, including works constitutional matters, creat-ing and optimizing employment agreements and labour law in connection with Mergers & Acquisition. Mr. Walderich is specialised in advising foreign compa-nies that are doing business in Germany. In addition, Mr. Walderich has special expertise in the law appli-cable to commercial agents.

Dr. Werner Oldenburg

Lawyer

born in 1945; Dr. Wern­er Old­en­burg stud­ied law and eco­nomics at the Uni­ver­si­ty of Tübin­gen 1965 – 1969; as­sis­tant lec­tur­er at the Uni­ver­si­ty of Tübin­gen (chair of Prof. Dr. H. Schröder) 1969 – 1973; ad­mis­sion to the Ger­man Bar in 1973. Dr. Old­en­burg has been a uni­ver­si­ty lec­tur­er on busi­ness and cor­po­rate law at the ESB Eu­ro­pean School of Busi­ness of Reut­lin­gen Uni­ver­si­ty.

Dr. Old­en­burg’s main fo­cus is pro­vid­ing le­gal ad­vice to mid-sized com­pa­nies and their bod­ies on all com­mer­cial, cor­po­rate and em­ploy­ment law re­lat­ed is­sues. In this re­gard he is reg­u­lar­ly in­volved in the ne­go­ti­a­tion and struc­tur­ing of com­mer­cial- and em­ploy­ment-re­lat­ed agree­ments. Dr. Old­en­burg al­so has a broad range of ex­pe­ri­ence, which in­cludes ad­vis­ing busi­ness en­ter­pris­es on com­pa­ny co-de­ter­mi­na­tion law, re­struc­tur­ing and trans­for­ma­tion of com­pa­nies and rep­re­sent­ing pub­lic en­ti­ties in cor­po­rate le­gal is­sues.

Dr. Old­en­burg is an ac­knowl­edged au­thor of nu­mer­ous pro­fes­sion­al ar­ti­cles and ref­er­ence books on com­pa­ny law, the law ap­pli­ca­ble to ini­tial pub­lic of­fer­ings and stock list­ings, com­pa­ny co-de­ter­mi­na­tion law and cor­po­rate pen­sion schemes.

Over many years until the end of 2013, Dr. Oldenburg had been a member of the management board of the firm.

Dr. Christina Mitsch

Lawyer

Dr. Christina Mitsch studied law at the universities of Munich and Würzburg. She has been a lawyer since 1990 and an accredited specialist in labour law since 1995. Certified as a company data protection officer (GDDCert. EU), she is also a member of the German Association for Data Protection and Data Security (GDD). She lectures at Berlin’s Humboldt-University and is regional manager Berlin of the Association of German Employment Lawyers (VDAA) and member of the Working Group for lawyers specialized in Employment Law, a section of the German Bar Association, the German Association of Labour Courts, the Berlin Circle of Friends and Sponsors of Labour Law and the Legal Society.

Christina is particularly experienced in the field of employee leasing, company’s pension schemes and data protection – in particular employee data protection. She advises and represents companies in addition to managing directors, board members and executives in all issues relating to labour law. This involves, among others, the individual design of employment contracts – including advice on remuneration (such as stock options), the protection of confidential information and covenants of non-competition. Christina represents all instances in court.

Ralf Fuhrmann

Lawyer

born in 1959; le­gal stud­ies at the Uni­ver­si­ties of Bochum, Lau­sanne and Tübin­gen; as­sis­tant lec­tur­er at the Uni­ver­si­ty of Tübin­gen (In­sti­tute for Labour Law and So­cial Law); At­tor­ney-at-Law since 1993; mem­ber of the VDAA (Or­gan­i­sa­tion of Ger­man Labour Law At­tor­neys); lec­tures par­tic­u­lar­ly on ser­vice re­la­tion­ships of com­pa­ny bod­ies and re­struc­tur­ing is­sues; co-founder of the Friedrichshafen Labour Law Days. Mr. Fuhrmann is a mem­ber of our law firm’s Man­age­ment Com­mit­tee.

Mr. Fuhrmann pri­mar­i­ly coun­sels and rep­re­sents com­pa­nies, as well as mem­bers of ex­ec­u­tive boards, man­ag­ing di­rec­tors, and ex­ec­u­tive em­ploy­ees, in all as­pects of labour law and the law on ser­vice con­tracts. Amongst oth­ers, he has spe­cial ex­per­tise and long ex­pe­ri­ence on re­struc­tur­ings in con­nec­tion with staff re­duc­tions in­clud­ing all ques­tions re­gard­ing rec­on­cil­i­a­tions of in­ter­ests and so­cial plans. Fur­ther­more, Mr. Fuhrmann is spe­cialised in the con­clu­sion and ter­mi­na­tion of em­ploy­ment re­la­tion­ships of board mem­bers and man­ag­ing di­rec­tors as well as in the de­ploy­ment of em­ploy­ees abroad. Mr. Fuhrmann rep­re­sents clients both out of court and in court in pro­ceed­ings in all in­stances.

Dr. Andreas Chmel

Lawyer

born in 1970; le­gal stud­ies at the Uni­ver­si­ties of Tübin­gen and Cata­nia; PhD at the Hum­boldt-Uni­ver­si­ty Berlin; Recht­san­walt since 2001. Lec­tures amongst oth­ers at the Uni­ver­si­ty of Tübin­gen; pub­li­ca­tions and le­gal opin­ions on labour law and the law on ser­vice con­tracts re­lat­ed sub­jects.

Dr. Chmel pri­mar­i­ly coun­sels and rep­re­sents em­ploy­ers, as well as ex­ec­u­tives in all as­pects of in­di­vid­u­al and col­lec­tive labour law. The con­sul­ta­tion of for­eign in­ter­na­tion­al com­pa­nies with ac­tiv­i­ties in Ger­many and Eu­rope is one of his main fo­cus­es. Dr. Chmel is, in­ter alia, spe­cial­ized in the con­clu­sion and ter­mi­na­tion of em­ploy­ment con­tracts and ser­vice con­tracts of man­ag­ing di­rec­tors and board mem­bers, lit­i­ga­tion and re­struc­tur­ing in­clud­ing as­pects of col­lec­tive bar­gain­ing law such as the “es­cape” from col­lec­tive bar­gain­ing agree­ments. Fur­ther­more, Dr. Chmel has spe­cial ex­per­tise in the law ap­pli­ca­ble to com­mer­cial agents.

Katrin Etteldorf

Lawyer

born 1977; studied law with specialized foreign-language training in English at the University of Augsburg. Attorney-at-law since 2004. Specialist attorney for labor law, for construction and architect law, and for banking and capital markets law.
Member of the Verband deutscher ArbeitsrechtsAnwälte e.V. (the Association of German Labor Law Attorneys), member of the working group for banking and capital markets law of the German Bar Association, member of the Saxony Bar Association’s specialized attorney committee for banking and capital markets.
On the individual and collective labor side, Ms. Etteldorf represents and advises employers, including medium-sized companies, and management. Her practice focuses on strategic negotiation and litigation management, the structure and implementation of reorganization and restructuring measures, and advising on and accompanying negotiations with the works council including, but not limited to, regarding interest balancing and social plans. In addition, Ms. Etteldorf assists with the implementation of entrepreneurial concepts, e.g., flexible work models and variable compensation. Moreover, Ms. Etteldorf conducts continuing education for human resources staff and senior management, especially by giving in-house seminars.
On the banking and capital markets, Ms. Etteldorf represents credit institutes, financial services companies, and leasing companies. She also has many years of experience in asset management. Litigation encompasses, on the one hand, enforcing contractual claims, and on the other, defending against claims alleging breach of contract.
